Terms of Service
These Terms of Service ("Terms") govern the use of Shelf Alerts ("the Service"), a Shopify application operated by LAT34 Corp ("we", "our", "us"). By installing, accessing, or using the Service, you agree to these Terms.
1. Service Description
Shelf Alerts provides Shopify merchants with tools for back-in-stock alerts, related subscriber analytics, and adjacent demand-recovery features such as preorder support, wishlists, low-stock urgency, retargeting, and connected messaging workflows.
2. For Shopify Merchants
By installing the app, the merchant authorizes us to access store data required to operate the Service, including products, inventory, orders, and related customer data made available through Shopify APIs.
The merchant is responsible for:
- Complying with applicable laws and regulations, including privacy, email, and SMS rules
- Obtaining any required customer consents before enabling notification channels
- Configuring storefront and consent language appropriate for the merchant's jurisdiction
- Paying subscription fees and any applicable usage-based charges shown inside the app
3. For Store Visitors and Subscribers
By subscribing through a merchant storefront, a shopper agrees to receive the transactional notifications they request, which may include:
- Email notifications when a subscribed product returns to stock
- SMS alerts if the shopper opted in with a phone number
- WhatsApp alerts if the shopper opted in through that channel
- Push notifications if the shopper accepted browser push permissions
Subscribers may unsubscribe using controls provided in the notification itself, including email unsubscribe links and SMS replies such as STOP.
4. Pricing and Billing
Shelf Alerts offers a free plan and paid plans billed through Shopify's billing system. Pricing, plan limits, and any usage-based charges are displayed in the app. We may update pricing prospectively, with changes taking effect according to Shopify's billing mechanics and applicable notice requirements.
5. Messaging Terms
- SMS and WhatsApp notifications are intended for transactional or requested inventory alerts, not broad promotional messaging by default
- Message frequency is limited to the subscribed item and relevant inventory event
- Carriers and third-party messaging providers are not liable for delayed or undelivered messages
- Message and data rates may apply depending on the carrier or platform

6. Privacy
Our collection and use of personal information is described in the Privacy Policy. By using the Service, you agree to the practices described there.
7. Availability and Warranties
The Service is provided on an "as is" and "as available" basis without warranties of any kind, express or implied. We do not guarantee uninterrupted availability, real-time delivery, or error-free operation.
8. Limitation of Liability
To the maximum extent permitted by law, LAT34 Corp is not liable for indirect, incidental, special, consequential, or punitive damages arising from use of the Service. Our aggregate liability for any claim related to the Service is limited to the fees paid for the Service in the 12 months preceding the event giving rise to the claim.
9. Suspension and Termination
Merchants may uninstall the app at any time through Shopify. We may suspend or terminate access for violations of these Terms, Shopify platform policies, or applicable law. Data handling after termination is governed by our retention and privacy policies.
10. Changes to These Terms
We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
